General Principle of Contract
These terms and conditions form a contract between you, the Customer
and Simply Silver Wholesale. By placing an order with us you are agreeing to
these terms and conditions.
Please read carefully before placing an order. All contracts will be governed by and construed in accordance with English Law and any dispute between us will be resolved in the courts of England and Wales.
All Prices Are shown in Pounds Sterling (£ GBP)
Eligibility to Trade
Simply Silver Wholesale will only supply to the trade and not to the general public. By pre-registering to access pricing information and ordering facilities you are affirming that you are a bona fide trader and that all transactions are on a business to business basis.
In order to assist in defining genuine traders, all customers wishing to buy from us must supply a trade reference. This can either be your business vat number or the name of a company with whom you already trade. If you object to providing these details we reserve the right not to trade with you. If you are a NEW BUSINESS with no vat number or trade references please enter 'New Business' in the trade reference box. Trade references are not for credit terms, they are used to verify your trade status only.
We reserve the right to delete or remove the registration details of anyone not providing the required information on the registration form to prove their trader status or a valid telephone number.
Ownership of Goods
All goods remain the property of Simply Silver Wholesale and ownership does not transfer to the customer until they have been paid for in full including shipping fees, any other charges levied and vat. We reserve the right not to trade with anyone who fails to make a full and proper payment for their order by whatever means.
Any item that we sell exclusively is associated with the Simply Silver Wholesale brand name and is © Simply Silver Wholesale. We reserve the right to refuse to supply anyone who acts in a manner which is likely to demean, devalue, copies or undermines that brand name.
We reserve the right to refuse to trade with anyone who approaches any of our manufacturers and attempts to undermine our position with them in any way.
Ordering & Minimum Order Value
Because we are a Trade Only Site, there is a minimum order requirement of £75 excluding shipping and vat. Orders below the minimum order value will be processed at your request but will be subject to a £15 handling fee excluding vat.
The minimum order value cannot be reduced by using credit notes.
Once an order has been successfully checked out it can not be cancelled. In the event that you need to add to your order after it has been successfully submitted, you should contact us by phone and if it is possible we will add to your order however if the order has already been processed we will be unable to make any changes.

Payment of Goods
All orders must be paid for in full prior to despatch
Our online and telephone payment systems are certified by WorldPay as being fully PCI DSS compliant.
We accept payments as follows:
- Online by credit or debit card**. All payments are 3d secured using 'Verified by Visa' or 'MasterCard SecureCode'.
- Telephone by credit or debit card**. Call on 01233 811601 with your card details bewteen 10am and 5pm Monday to Friday (excluding UK Bank Holidays).
**We do not accept American Express, JCB or Diners Club card or PayPal payments.
- By sending us a cheque drawn on a UK Bank only and made payable to Simply Silver. Note: We reserve the right not to send any order paid for by means of a cheque until such cheque clears into our bank. This may delay your order being despatched by up to 10 days. Any cheque referred to drawer by your bank will be subject to a £20 administration fee that will be added to your order total to pay.
If any payment is the subject of a chargeback or is referred to drawer by their bank then the complete order remains our property until paid for in full. Any payment referred to drawer or declined by the customers bank will be subject to a £20.00 administration fee for each and every failed referral. We reserve the right not to trade with anyone who fails to make a full and proper payment for their order by whatever means.
- Bank Transfer: If you wish to use this method, all bank charges will be covered by the customer and not Simply Silver Wholesale. Bank details will provided upon request to use this method of payment.
All items sent remain the property of Simply Silver Wholesale until paid for in full including any shipping charges, VAT and any supplementary charges levied within the statement of these terms and conditions.
If payment for any item or charge or supplement remains outstanding we reserve the right to take action to recover the monies owed by means of civil action or passing the debt to a debt collection agency as necessary.
UK orders will be sent by Royal Mail special delivery and require a signature upon delivery. Overseas orders are shipped via International Signed For Mail and will require a signature upon delivery. All orders are fully insured.
UK orders received before 12 noon will normally be shipped the same day for next day delivery
UK orders received after 12 noon will normally be shipped the following day for next day delivery
International orders will be shipped as above but will take longer for delivery

Any order returned to us due to a failed delivery will be subject to a redelivery charge. This will be charged at the same rate as the original shipping fee. When the order has been despatched your account will be updated and an email will be sent to reflect the new status. UK orders will usually arrive the day after the status update normally before 1.30pm. If in doubt add a shipping address to your order where there will definitely be someone to sign for your parcel during the normal working day.
Shipping is currently £7.00 to mainland UK. We reserve the right to amend shipping
charges without notice.
Shipping charges for Overseas and International orders are calculated at the checkout.
Insurance and Returns for Damaged Items
All items sent via Special Delivery are insured for damage.
a. We must be notified within 3 days of any claim for damages. All original packaging must be kept until informed otherwise in case the carrier wishes to inspect it.
b. All parcels must be signed for on receipt and signed for as “unchecked” on the carrier’s manual or computerised hand held records. If an item is not signed for, and signed for as "unchecked" then no claim can be made.
c. No items can be returned without authorisation by us in writing (usually by email).
d. Damaged items will only be replaced, credited for or refunded to you upon completion of a successful claim against the carrier. In all cases the items will need to be returned to us for inspection and completion of the claim. Returning the items is at your expense.
No claim for damages will be entertained if the external packaging of the item has been forcibly ripped open or otherwise inappropriately opened. A small penknife will open 99% of the protective packaging of all items without such damage being caused. We cannot make a claim if the item packaging is damaged unnecessarily so will not entertain a claim if it has.
e. All parcels sent Internationally (that is, outside the UK) are insured for loss. In the event of non-receipt of the goods, a parcel will not be deemed lost until 30 days following the date of posting have expired. The posting date will be assumed as the same date as the Despatch update shown on your order status. After the 30 day period a claim will be made to the postal service who will trace the parcel. In the event that it is not located we will be recompensed for the order value which will then be re-credited to your debit/credit card. For faulty items please see the above paragraphs for procedures to be followed. All faulty items are to be returned to us at your own expense for any refund, replacement or credit claim to be made. If you merely do not like an item we will not normally accept its return for that reason. We will not accept any unauthorised return and will charge you as detailed above if you do so.
Any returns, damages, errors or omissions must be notified to us within 5 days of receipt of the order. If outside this period we may refuse to accept returns under any circumstances.
We do not have a 'sale or return' policy. We will only accept returns that are authorised by us in writing (usually by email). For unauthorised returns you will be charged an administration and restocking fee of 20% of the order total. This can be a considerable amount so always get any returns authorised.
We will only accept returns for faulty or damaged items. If you merely do not like an item or items and wish to return them we may accept a return but it is entirely at our discretion as to whether we do so or not and if the return is accepted you will be charged a 20% restocking fee.
If an item is returned as faulty you may elect for a replacement, a credit note for the item value off your next order or a refund if the cost amounts to more than £10.00. We will require the faulty item to be returned to us in the original packaging for inspection at your expense. Claims will only be entertained if the item is received in good as new condition (except obviously for the reported fault), in the original packaging and is advised to us within the 5 day time frame. All return shipping costs are made at your own expense. Due care must be taken to ensure they arrive safely back with us so you are advised to send any returns by at least Recorded Delivery to ensure the items can be tracked.
Do to Health & Hygiene Laws we can not accept returns for earrings or any items that may penetrate the skin unless they are faulty.

We will not back order items for you except at our own discretion. We will advise you (usually by email) if we will or can back order an item for you.
If there are items that are out of stock we will only charge you for the amount of goods actually sent. Should the out of stock item(s) cause your order to fall below the minimum order value you will not be charged the below minimum order fee.
Credit notes cannot be redeemed against a minimum order value. So if for example, you have a £20 credit note that you wish to redeem, then your order must reach your minimum order value plus £20.

8.1. VAT will be charged at 20% on all
items sent within the UK. VAT is chargeable on the whole order after
shipping and any other costs have been added. Prices shown on the website exclude VAT.
8.2. Customers who are outside the European Union are responsible for ensuring they pay their own State and local taxes and that they do not import any prohibited items from us. Any problems with their own customs or taxation authorities is entirely down to them.
8.3 If you
are an overseas trader but WITHIN the European Union and are registered
for VAT, VAT will be shown on your order total at the time you check out your order and you will receive an email showing this total. Payment will NOT have been taken from your card at this point. We will check the vat number with the European Commission Vies website and providing it is correct we will deduct the vat from the invoice and collect the payment. A new email will be sent to you confirming the payment LESS the vat amount. We reserve the right
to charge customers VAT if the ec.europa.eu/taxation_customs/vies/ website does not recognise any
of the details given.
8.4 Traders within the European Union who are not registered for VAT will be charged 20% on the whole order total after shipping and any other costs have been added at the time of processing. You may notify us if your status relating to VAT changes and section 8.3 (above) will then become applicable.
- All items sold as magical products are sold as curios only. No claim is made as to their magical properties or otherwise.
- Whilst we take due care and attention in the marketing and safety of our products, if you purchase a product from us and find a safety hazard please inform us immediately so that we can take the appropriate action.
- We reserve the right to alter, amend, add or delete any of these terms and conditions as necessary without notice. They are published on the web site at www.simplysilverwholesale.com and are there for all to view.
- All images contained on our website www.simplysilverwholesale.com are © Simply Silver Wholesale and cannot be used without our written permission. In the event that our intellectual property rights are infringed, we will insist that the images be removed from the site in question. Failure to do so will result in the matter being passed to our legal team.
